Following the VCAT appeal to the EPA’s decision to issue the Works Approval, Thirteenth Beach Coastwatch appealed the VCAT decision in the Supreme Court.

The case was heard in early January 2009, with the decision being handed down in Plenary Environment and the EPA’s favour on 23 February 2009.
